Flat Lake in Winter, by Joseph T. Klempner

New York defense attorney Matthew Fielder has quixotically left a law practice and urban living to build himself a cabin in the Adirondack woods and get by on a legal aid pension and whatever small lawyer-work comes his way. But because in that sparsely populated area of New York State Fielder is the only criminal defense attorney qualified enough to take on a death penalty case, he is almost forcibly enlisted to do just that. He has been through "Death School," the course given by the State to acquaint defense lawyers with the intricacies of the newly reinstated death penalty law and with the additional resources the law provides the defense in such cases.

Reluctantly, Fielder agrees. His client, he finds, is Jonathan Hamilton, variously regarded in the small rural community as "nearly retarded" or, more charitably, "slow." The young man has called the authorities one frosty morning to say his wealthy grandparents, with whom he lives, have been "hurt real bad." In truth, the police find, the couple has been brutally and bloodily slashed to death. Jonathan doesn't remember what happened; his guilt seems obvious to everyone, including his attorney.

Fielder's job is to save the boy's life. And slowly, he begins to feel the remembered excitement of the fight to win a case; even more, he is warmed by a growing emotional involvement with the simple young man who can be made happy with Fielder's gift of a blanket to wrap himself in against the prison cold. (Jonathan's first question to his attorney when they meet is "Are they going to kill me tonight?")

Fielder gathers all the support staff the law allows him, an odd but loyal and effective group. Gradually they start to notice some small but possibly important discrepancies in the case against their client, and to uncover some possibly relevant secrets hidden in the past of Jonathan's wealthy family. Eventually, Fielder comes to believe that Jonathan may not, after all, have killed his grandparents. And if he didn't who did?

Joseph Klempner has been honing the extraordinary talent that has been apparent from his first book, Felony Murder, and the deftness with which he uses his wide background in law and law enforcement to tell a story that will grip the reader until the very last sentence. With the resurgence of the death penalty in the news, Flat Lake in Winter puts the conflicts of legal killing in human terms from an author who is at the very top of his form.

From Publishers Weekly
A death-row lawyer weighs the risks of taking on a potentially indefensible case of a slow-witted man accused of murdering his grandparents in this absorbing, tough-minded thriller from New York attorney Klempner (Change of Course). Among law-enforcers in remote Flat Lake, N.Y., word is that the case against Jonathan Hamilton is "an absolute lock": a clear trail of blood, hair and footprints implicates the man-child in the stabbing deaths of his sleeping grandparents. With Jonathan's apparent confession, "meateating" DA Gil Cavanaugh announces he'll seek the death penalty, despite Jonathan's borderline retardation. So when former Legal Aid lawyer Matt Fielder inherits Jonathan's defense, he has his work cut out for him. The momentum shifts when Fielder, somewhat unconvincingly, becomes romantically involved with Jonathan's "drop-dead gorgeous" sister, who reveals Jonathan's long history of sleepwalking. Is it possible that Jonathan killed his grandparents in his sleep? If so, will a sleepwalking defense save him from death row? Klempner's delicate meditations on legal and moral responsibility, and his riveting depiction of capital case warfare, make this novel stand out from the pack of plot-driven legal thrillers. His low-key, folksy style is occasionally mannered, especially when he adopts the objective jargon of a police report or waxes poetic about the charms of Flat Lake. But readers will be moved by the plight of the bewildered defendant and challenged by the "full-fledged psychodrama" arising from possibly unconscious acts. Agent, Bob Diforio.

From Library Journal
Klempner (Shoot the Moon, LJ 7/97) sets this beautifully written story about the aftermath of a horrific double homicide in Flat Lake, NY, a small community in the heart of the Adirondack Mountains. Jonathan Hamilton, a mildly retarded adult, has confessed to murdering his grandparents. This is an automatic death-penalty case and requires a defending attorney who has been to "Death School," a course on the procedures required to defend against New York's reenacted death penalty. Matthew Fielder, a lawyer who doesn't like being responsible for his client's life, is chosen to defend Jonathan. Matthew and his unique defense team must contend with a district attorney running for reelection, a quarrelsome judge, and a defendant who does not remember the murder. Criminal defense attorney Klempner's descriptions of the stark winter wilderness juxtaposed with the stark realities of the death penalty, as well as an ingenious plot line with appealing characters, make this one of the best lawyer-written novels to date.?Annelle R. Huggins, Univ. of Memphis Libs.

From Kirkus Reviews
A thoroughly entertaining legal thriller in which a young man who believes he's committed murder may have it wrong. They don't get much crime way up in the Adirondacks, especially in the winter, but when it happens, it happens big. Young Jonathan Hamilton is a quiet boy, a slow boyall right, some say retarded. But nobody around Flat Lake had ever thought of him as violent until the day his grandparents were found hacked to bits, with Jonathan sitting nearby in a river of gore. Arrested, he confesses. Jailed, he's charged with first degree. His prosecutor will be an out-for-blood D.A. eager for the political hay to be harvested by executing Jonathan now that New York State has reinstated the death penalty. Which is when Matt Fielder comes down from the mountain. Matt, a good lawyer, though disenchanted for sundry reasons, has been leading a Thoreau-like existence in a log cabin built lovingly by himself. But it seems he's the only attorney within Shanghaiing distance who's gone through The Death School, a specialized training course developed to better prepare public defenders to cope in capital trials, and, an idealist (and closet competitor), he allows himself to be drafted. On a budget from hell, Matt manages to cobble together a first-rate team of investigators and researchers. So what really happened on the night Carter and Mary Alice Hamilton were offed? A combination of luck, labor, and clever sleuthing turns up an answer that leads to a solid defense. But then, amidst of triumph, Matt is rocked to learn that his winning answer may be the wrong one after all. Defense attorney Klempner (Shoot the Moon, 1997, etc.) still occasionally sounds more like a lawyer than a novelist, but, this time, we get an absorbing story and an engaging cast. And the ending is a smash. -- Copyright ©1998, Kirkus Associates, LP. All rights reserved.

Different Writing Style
By H. Morey
This book is written as though a third person is confiding the story of a defense attorney, Matt, who is hired to defend Johnathon, a mentally handicapped young man. Jonathon is accused of brutally murdering his grandparents while they slept. The writer tells the story as a third person, who has all of the inside information. There are a few twists but I felt that the ending was somewhat predictable and a bit forced, otherwise I enjoyed the book..

Slow but steady
By MsDAB
Initially I couldn't quite figure out what direction this story was headed. Because I was puzzled I had to keep reading. Boy am I glad I did. The story is slow but steady...and I didn't see the end coming.
I enjoy murder mysteries and this one was just enough different that it kept me flipping pages. Plod along with it and you'll be glad you did, too.

Have a go at it - you'll be glad you did
By Tony Martyr
I was genuinely surprised by how good this was, how satisfying and interesting. Wasn't expecting much (got it on a cheap Kindle deal), but then bought his other two books. Told in a knowing, folksy way - but it really works. Not sure if he intends the characters to reappear, but I'd like to live and grow with them a bit.
